In the state of Florida, anyone including a bank or an individual could act as an agent under power of attorney. The question is not who could act, but who should act? You should choose an individual who you have a close relationship with, whether it be a child or a grand child, or possibly a niece or nephew. That person should be somewhat familiar with your assets and more importantly should be close in proximity physically to where you live because the use of a power of attorney may be required in a very short period of time.
